Amendments to the Portuguese Industrial Property Code

The Industrial Property Code in Portugal has been amended and the new provisions will come into force on October 1, 2008. The new Code includes several significant changes in the Portuguese IP Law.

Trademarks

One of the most relevant changes concerns the fact that the filing of periodical Declaration of Intent to Use (DIU) is no longer required in order to keep a trademark registration in force.

However the requirement of the DIU continues to be valid for Trademarks in Mozambique.

Patents

Rules for provisional patent applications will be adopted.

Designs

The examination of a design application will be abolished except when an opposition has been filed.
