Revised Chinese patent law will come into force as of October 10, 2009

Some of the most important changes in the Chinese patent law are as follows:
* absolute novelty of invention
* applicant’s own earlier filed but later published patent application may destroy the novelty of the invention disclosed in his own later filed application
* the same applicant may file, on the same date, a patent application and an application for utility model for the same invention
* adopting the Bolar provision allowing the conducting of experiments required for obtaining a regulatory approval for a patented drug or medical device
